Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the LancstTrack platform, website, APIs, and all related services (collectively, the "Service") provided by Lancst LLC. ("LancstTrack," "we," "us," or "our"), accessible at lancst.com. By accessing or using the Service, you agree to comply with this AUP. This AUP is incorporated by reference into our Terms of Service. Capitalized terms not defined herein have the meanings set forth in the Terms of Service.

1. Prohibited Activities

You agree not to use the Service to engage in, facilitate, or support any of the following prohibited activities. This list is non-exhaustive, and LancstTrack reserves the right to determine, in its sole discretion, whether any conduct violates this AUP.

1.1 Illegal Data Collection

You must not use the Service to collect, store, process, or transmit personal data in violation of any applicable law, regulation, or industry standard. This includes, but is not limited to:

  • Collecting personal data without obtaining valid, informed, and freely-given consent where required by applicable data protection laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the California Privacy Rights Act (CPRA).
  • Collecting sensitive categories of personal data (such as health information, biometric data, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, or financial account information) through the Service without explicit consent and a lawful basis for processing.
  • Failing to provide clear and conspicuous privacy notices to end users whose data is collected through the Service, including information about what data is collected, how it is used, and with whom it is shared.
  • Collecting, processing, or transferring personal data across international borders in violation of applicable cross-border data transfer requirements, including the absence of appropriate safeguards such as Standard Contractual Clauses (SCCs) or binding corporate rules.

1.2 Tracking Minors

You must not use the Service to knowingly collect, track, or process personal information from children. Specifically:

  • You must not use the Service to collect personal information from children under the age of 13 in violation of the Children's Online Privacy Protection Act (COPPA) or equivalent laws in your jurisdiction.
  • For users subject to the GDPR, you must not use the Service to process personal data of children under the age of 16 (or such lower age as permitted by the applicable EU member state, but in no case below 13) without verifiable parental or guardian consent.
  • You are solely responsible for implementing appropriate age verification or age-gating mechanisms on your websites and applications before deploying the LancstTrack tracking script. If you become aware that data from a minor has been inadvertently collected, you must notify LancstTrack immediately at [email protected] and take steps to delete such data without delay.
  • LancstTrack does not intentionally collect or process data from children. If we become aware that we have inadvertently received personal data from a minor, we will take prompt steps to delete such data from our systems.

1.3 Scraping and Reverse Engineering

You must not engage in any of the following activities:

  • Scraping, crawling, or using any automated means (including bots, spiders, scrapers, or scripts) to access, extract, or collect data from the Service, its databases, dashboards, reports, or APIs beyond the scope of your authorized use.
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, data structures, or trade secrets underlying the Service or any of its components.
  • Copying, reproducing, or creating derivative works based on the Service, its design, features, user interface, or underlying technology without our prior written consent.
  • Circumventing or attempting to circumvent any rate limits, API quotas, access controls, or other technical limitations imposed by the Service.

1.4 Distribution of Malware

You must not use the Service to distribute, deploy, host, or facilitate the spread of malicious software or harmful code. This includes, but is not limited to:

  • Embedding viruses, trojans, worms, ransomware, keyloggers, spyware, adware, or any other form of malicious code within tracking scripts, event payloads, or any data transmitted through the Service.
  • Using the Service as a delivery mechanism for phishing attacks, drive-by downloads, or exploit kits.
  • Injecting malicious scripts (including cross-site scripting or XSS payloads) through custom event properties, metadata fields, or API requests.
  • Using the Service to perform or facilitate denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any third party.

1.5 Spam and Unsolicited Communications

You must not use the Service to facilitate, enable, or support unsolicited communications or spam. This includes:

  • Using data collected through the Service to send unsolicited bulk emails, text messages, push notifications, or any other form of electronic communication to end users who have not explicitly opted in to receive such communications.
  • Using the Service in conjunction with email harvesting tools or to build lists of email addresses or other contact information for the purpose of sending spam.
  • Violating the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), the EU ePrivacy Directive, or any other applicable anti-spam legislation.
  • Using the Service to generate, send, or facilitate chain letters, pyramid schemes, or any form of multi-level marketing solicitation.

1.6 Impersonation

You must not use the Service to impersonate or misrepresent your identity or affiliation. This includes:

  • Creating accounts or using the Service under a false identity or under the name of another person or entity without proper authorization.
  • Impersonating LancstTrack, its employees, representatives, or affiliates to third parties.
  • Using the Service to create fake or misleading analytics data, falsified event streams, or fabricated user tracking information for the purpose of deceiving third parties.
  • Misrepresenting the source, origin, or nature of data collected through the Service to end users, partners, or regulatory authorities.

1.7 Circumventing Security Measures

You must not attempt to bypass, disable, or interfere with any security features or protections of the Service. This includes:

  • Attempting to gain unauthorized access to any accounts, systems, networks, or data belonging to LancstTrack or other users of the Service.
  • Probing, scanning, or testing the vulnerability of the Service or any system or network connected to the Service without our prior written authorization (authorized security researchers should contact [email protected] to coordinate responsible disclosure).
  • Interfering with, disrupting, or attempting to disrupt the integrity, performance, or availability of the Service, including overloading servers, flooding networks, or sending malformed requests.
  • Bypassing or attempting to bypass authentication mechanisms, encryption, access controls, usage limits, or any other security or protective measures implemented by LancstTrack.
  • Sharing, transferring, or otherwise making available your account credentials, API keys, or access tokens to unauthorized parties.

1.8 Use for Illegal Purposes

You must not use the Service for any purpose that is illegal or that facilitates illegal activity. This includes, but is not limited to:

  • Using the Service in connection with websites, applications, or services that promote, facilitate, or engage in illegal activities, including fraud, money laundering, drug trafficking, human trafficking, terrorism, or the sale of illegal goods or services.
  • Using the Service to track or monitor individuals for the purpose of stalking, harassment, intimidation, or any form of illegal surveillance.
  • Using the Service in violation of export control laws, sanctions, or trade embargoes imposed by the United States or any other applicable jurisdiction. You must not use the Service if you are located in, are a resident of, or are a national of any country subject to comprehensive U.S. sanctions.
  • Using the Service to infringe upon the intellectual property rights of any third party, including copyrights, trademarks, patents, and trade secrets.
  • Using the Service to discriminate against individuals on the basis of race, color, religion, sex, national origin, age, disability, genetic information, or any other characteristic protected under applicable law.

2. User Responsibilities

As a user of the Service, you acknowledge and agree to the following responsibilities:

  • Legal Compliance: You are solely responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations, including data protection and privacy laws such as GDPR, CCPA/CPRA, COPPA, PECR, and any other applicable legislation.
  • End User Consent: You must obtain all necessary consents from your end users before collecting or processing their data through the Service. You are responsible for providing adequate privacy notices and maintaining records of consent where required by law.
  • Accurate Information: You must provide accurate, current, and complete information when creating your account and must update such information promptly if it changes. You must not provide false or misleading information about yourself, your organization, or your intended use of the Service.
  • Account Security: You are responsible for maintaining the confidentiality and security of your account credentials, including passwords, API keys, and access tokens. You must notify LancstTrack immediately at [email protected] if you suspect any unauthorized access to or use of your account.
  • Data Retention and Deletion: You are responsible for managing your data retention settings in accordance with applicable law. You must ensure that data collected through the Service is not retained longer than necessary for the purposes for which it was collected.
  • Third-Party Integrations: If you use the Service in conjunction with third-party tools, platforms, or integrations, you are responsible for ensuring that such use complies with this AUP, the Terms of Service, and the terms of service of the applicable third parties.
  • Cooperation: You agree to cooperate with LancstTrack in any investigation of suspected violations of this AUP, including providing information and access to relevant records upon request.

3. Monitoring and Compliance

LancstTrack reserves the right, but is not obligated, to monitor your use of the Service for compliance with this AUP. Our monitoring practices include:

  • Automated Monitoring: We employ automated systems to detect unusual patterns of usage, potential abuse, and violations of this AUP. This may include monitoring event volumes, API request patterns, and account activity for anomalies.
  • Manual Review: LancstTrack may conduct manual reviews of accounts and usage patterns when there is a reasonable basis to believe that a violation of this AUP has occurred or is occurring.
  • Log Retention: We maintain system and access logs for security, compliance, and enforcement purposes. These logs may be used to investigate suspected violations and may be shared with law enforcement authorities when required by law or when necessary to protect our rights, the rights of other users, or public safety.
  • No Obligation to Monitor: While we reserve the right to monitor usage, we are under no obligation to do so. The absence of monitoring does not relieve you of your obligations under this AUP, and you remain solely responsible for your use of the Service.
  • Compliance Audits: For Enterprise customers, LancstTrack may conduct periodic compliance audits to ensure adherence to this AUP and applicable data protection regulations. You agree to cooperate with such audits and provide requested documentation in a timely manner.

4. Enforcement Process

If LancstTrack determines, in its sole discretion, that you have violated this AUP, we may take one or more of the following enforcement actions, depending on the severity, frequency, and nature of the violation:

4.1 Warnings

For first-time or minor violations, LancstTrack may issue a written warning via email to the account owner. The warning will:

  • Identify the specific provision(s) of this AUP that have been violated.
  • Describe the activity or conduct that constitutes the violation.
  • Specify a reasonable timeframe (typically 5 to 14 business days) in which you must remedy the violation and bring your use of the Service into compliance.
  • Outline the potential consequences of continued non-compliance, including suspension or termination of your account.

4.2 Suspension

LancstTrack may suspend your account or access to certain features of the Service if:

  • You fail to remedy a violation within the timeframe specified in a warning.
  • The violation is of a serious nature that, in our sole judgment, warrants immediate suspension without prior warning (including but not limited to malware distribution, tracking of minors, or illegal surveillance).
  • Your use of the Service poses an imminent threat to the security, integrity, or availability of the Service or to other users.
  • Repeated or multiple violations have been identified, regardless of whether individual warnings were issued for each.

During a suspension, your access to the Service (including dashboards, APIs, and data exports) may be restricted or disabled entirely. Data collected prior to suspension will be retained in accordance with our data retention policies but may not be accessible to you during the suspension period.

4.3 Termination

LancstTrack may permanently terminate your account and access to the Service if:

  • You fail to remedy a violation during a suspension period.
  • The violation is of such a severe nature that termination is warranted immediately (for example, distribution of malware, knowingly collecting data from children without consent, or use of the Service for illegal purposes).
  • You have accumulated a pattern of repeated violations over time.

Upon termination, your account will be permanently deactivated. You will have 30 days from the date of termination notice to export your data, after which all data associated with your account will be permanently deleted from our systems. Any prepaid fees for unused portions of the Service are non-refundable in the case of termination due to AUP violations. LancstTrack reserves the right to report violations to relevant law enforcement authorities where appropriate.

5. Account Suspension and Termination Procedures

The following procedures apply to account suspensions and terminations:

  • Notification: LancstTrack will notify you of a suspension or termination via the email address associated with your account. The notification will include the reason for the action, the specific AUP provisions violated, and any steps you may take to appeal or resolve the issue.
  • Appeal Process: If you believe that a suspension or termination was made in error, you may submit a written appeal to [email protected] within 15 business days of the notification. Your appeal must include a detailed explanation of why you believe the action was unwarranted and any supporting evidence. LancstTrack will review your appeal and respond within 10 business days.
  • Data Export: In the event of termination, you will be provided a 30-day grace period during which you may export your data through the Service's data export tools or API (subject to applicable access restrictions). After the grace period expires, all account data will be permanently deleted in accordance with our Privacy Policy.
  • Refund of Prepaid Fees: Accounts terminated due to AUP violations are not eligible for refunds of any prepaid or unused subscription fees. If your account is suspended and subsequently reinstated, you will not be credited for the period of suspension.
  • Re-registration Prohibition: If your account is terminated for an AUP violation, you are prohibited from creating a new account or using the Service under a different identity without our prior written consent.

6. Reporting Violations

If you become aware of any conduct that you believe violates this AUP, we encourage you to report it promptly. Violation reports help us maintain a safe and secure platform for all users.

When submitting a violation report, please include the following information to help us investigate effectively:

  • Your name and contact information (so we can follow up if needed).
  • A detailed description of the suspected violation, including the specific activity or behavior observed.
  • The date(s) and time(s) of the suspected violation, if known.
  • Any relevant evidence, such as screenshots, URLs, log files, or email headers.
  • The account name, domain, or other identifying information of the party suspected of violating this AUP, if known.

LancstTrack will review all violation reports and, where appropriate, take enforcement action in accordance with Section 4 of this AUP. We may not be able to disclose the outcome of our investigation or any enforcement actions taken due to privacy and confidentiality obligations. We will not retaliate against anyone who reports a suspected violation in good faith.

7. Modifications to This Policy

LancstTrack reserves the right to modify this AUP at any time. We will provide notice of material changes by posting the updated policy on our website and updating the "Effective Date" at the top of this page. For significant changes, we may also notify you via email. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised AUP. If you do not agree with the changes, you must discontinue your use of the Service. We encourage you to review this AUP periodically to stay informed of any updates.

8. Relationship to Other Policies

This AUP is part of and supplements our Terms of Service. In the event of a conflict between this AUP and the Terms of Service, the Terms of Service shall prevail to the extent of the conflict. This AUP should be read in conjunction with our Privacy Policy, Cookie Policy, and Refund Policy, which together govern your use of the Service.
